omg if biden gets prosecuted for human trafficking, I will never shut up about it to my liberal family
The Biden administration set precedent for when a former president can be prosecuted. The next 200 years will just be one administration prosecuting the next.
yah, but trump also set a precedent for the immunity stuff he got, no?
Yeah. But it's defined now. SCOTUS has spoken. The question is whether the acts are in the course of his official duties. Unofficial acts are only protected if prosecution would affect the functioning of the executive generally (that the risk of prosecution would deter a president from carrying out his official duties / making decisions related thereto, etc).

I do not see why a President can not perform Presidential duties while in house arrest where he can not leave the White house as a Presidential Jail

A president can't be prosecuted for federal crimes while in office. He is the executive. He can't prosecute himself. So he has to be out of office first.

As for state crimes, I assume they'd be stayed until he's out of office. Otherwise, states would regularly use their police powers to interfere with the executive and in violation of the Supremacy clause.

@Humpleupagus @Tony

I am just saying they could put him in jail while in office and he could still Veto stuff if they wanted to do things that way

I am not saying whether or not they consider it to be that way legally

There's this modern misunderstanding that AGs prosecute. This false. The AGs power is derived from the executive himself, and the executive can directly prosecute. See Jefferson's apprehension and prosecution of Burr.

The laws of the United States of America only exist in people's minds and are an imaginary thing not a real thing

How people choose to physically act on these imaginary beliefs has a real impact on the world

There is no such thing as objectivity when it comes to U.S.A. laws

There are only people's subjective opinions

An objective understanding of people's subjective opinions allows an objective understanding of how people will act based on their subjective delusions

One of these is a table, the other is a cable spool.
